The term 'escrow' is used in many ways to describe specific details of a real estate transaction. Escrow is a service which contracts a neutral third-party to secure transactions, hold legal documents as well as money/funds on behalf of the buyer and seller. The escrow process was put in place to ensure the protection of the principals (buyer, seller and lender). Escrow services minimize risk, protect and provide clients with convenience. An escrow officer is a licensed, unbiased third-party who oversees the transfer of funds and related documents between the principals.
The closing process follows five steps: (1) Starting the process — a sales contract is delivered and a title order is initiated. (2) Title search and examination — a search of public records including wills, liens, deeds, and mortgages is conducted. (3) Document preparation — the closing agent reviews lender requirements and preps closing statements. (4) Settlement/closing — the escrow officer supervises the signing and transfer. (5) Post-closing — payment is distributed, documents are recorded in the county, and title insurance policies are delivered.
A title commitment is Trident's promise to issue a title insurance policy after the closing on a property. The commitment will have terms, conditions and exclusions consistent with the actual insurance policy. It confirms the buyer obtains a clear title on the property and the seller fixed certain conditions and issues.
The major difference is when each is issued. The commitment is issued before closing and a title policy is issued after closing.
